Don't let court forms intimidate you, they are self explanitory - You will need atleast three copies of each when making applications to court. Click on the document image or link to view, save and print them, alternatively you can visit your local family court office and request them over the counter (they are free)..... Court clerks will not give legal advice but can assist with which form / documents you may require - When applying, apply for all everything you need, as it is one fee (everytime you make applications - around £185, fees usually require to be paid by cash - cards/plastic not usually accepted!)

 This sample parenting guide is NOT a legal document and is NOT an order of the court, NOR is it intended to be enforced by courts. This is simply a guide with key issues to help you mutually agree and make your own arrangements. As your child(ren) grow up the plan may need revising from time to time.  This form should be used when making an application for an order in your favour:

 

·       Residence Order or Shared Residence Order


·       Contact Order


·       Specific Issue Order - Over parental disputes related to Parental Responsibility. For example over school / education, medical treatment, religion, plans to take the child / children on holiday abroad, etc.....


·       Prohibited Steps Order - Steps to prevent the other parent from removing the child / children from the UK & Wales ie: abroad, limiting their ability to make certain decisions eg; child's / children's education, medical treatment, religion etc.

·       The child / children or yourself have been subject to violence, abuse or neglect;

·      Application - for leave to commence proceedings for an order or directions in existing family proceedings or to be joined as or ceased to be a party in existing family proceedings


·       Eg: A step-parent wishing to be joined as a party to proceedings


·       You or another person no longer wishes to be a party in the proceedings.

This form should be used when accompany a C1 form when applying to the courts for contact with a child in care & should only be used when:


·      You are the Parent or Guardian for the child / children

This form is a supplemental form which should accompany a C3 Form (application to recover a child  / children)

This form is used if you wish to apply for a warning notice to be attached to an existing Contact Order.

This form should be only used to apply for enforcement of an existing contact order (eg: Resident parent fails to maintain the Contact Order terms agreed & stipulated by the courts).

A Family Court Judge has the power to imprison, fine, or make the resident parent carry out community service for being in breach of a Contact Order.

 

     You may further request the court's assistance by way of:


·   12 month Family Assistance Order (at the courts discretion). To direct  CAFCASS  be involved & assist in facilitating & monitoring the ordered contact for a maximum period of 12 months


·   Family Counciling. If the resident parent claims / the child / children do not wish to see you, family counciling can be a useful to negociate solutions between parents, also helping you rebuild the relationship with your child / children


·      Parenting Classes - (Although it is now common practice for the Court to order Parenting Classes at finding of fact hearings & other hearings)

A formal & legal agreement, made by consent between the mother & father and witnessed by an approved court official. Granting the father legal Parental Responsibility (named on birth certificate)

Step-Parent Parental Responsibility Agreement Section 4A(1)(a) Children Act 1989 made by consent and witnessed by an approved court official, between the mother and step-father, and any other named person with parental responsibility, granting the step-father legal parental responsibility for the child / children.

If the biological father does not have parental responsibility (name on birth certificate), his consent is not required by law.

An agreement between the mother & her same sex partner, who is recognised as the other parent by virtue of the Human Fertlisation and Embryology Act 2008.
